Terms of Use - Range Training

1. Acknowledgement

You and the developer of Range Training ("the Developer") acknowledge that these Terms of Use are concluded between you and the Developer only, and not with Apple. The Developer, not Apple, is solely responsible for the Range Training application ("the App") and the content thereof. These Terms of Use may not provide for usage rules for the App that are in conflict with the Apple Media Services Terms and Conditions as of the Effective Date.

2. Scope of License

The Developer grants you a limited, non-transferable license to use the App on any Apple-branded Products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that the App may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.

3. Description of Service

Range Training is a mobile application designed to help competitive shooters log, score, and analyze their training drill performance. The App provides timing integration, scoring calculations, and performance tracking tools.

You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. Please see our Privacy Policy for details on how we handle your information.

6. Acceptable Use

You agree not to use the App for any illegal purposes or in any way that could harm, disable, or impair the service.

7. Maintenance and Support

The Developer is solely responsible for providing any maintenance and support services with respect to the App, as specified in these Terms or as required under applicable law. You and the Developer acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.

8. DISCLAIMER OF WARRANTIES

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. The Developer is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you; and, to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be the Developer's sole responsibility.

9. Product Claims

You and the Developer acknowledge that the Developer, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including, but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation, including in connection with the App's use of the HealthKit and HomeKit frameworks. These Terms may not limit the Developer's liability to you beyond what is permitted by applicable law.

10. Intellectual Property Rights

You and the Developer acknowledge that, in the event of any third party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, the Developer, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim.

11. Third-Party Integrations

The App may integrate with third-party devices (such as shot timers) and services. We are not responsible for the functionality, accuracy, or safety of third-party products or services.

12. Third-Party Terms of Agreement

You must comply with applicable third-party terms of agreement when using the App. For example, you must not be in violation of your wireless data service agreement when using the App.

13. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, DEATH, OR LOSS OF PROFITS, ARISING OUT OF OR RELATING TO YOUR USE OF THE APP.

14. Indemnification

You agree to indemnify and hold harmless the Developer from any claims, damages, or expenses arising out of your use of the App, your violation of these Terms, or your participation in shooting activities.

15. Legal Compliance

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

16. Third-Party Beneficiary

You and the Developer acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

17. Governing Law

These Terms are governed by the laws of the State of Texas, United States of America, without regard to conflict of law principles.
